1. Who we are

HoopSide (the "Service") is published by [your full legal name or business name], whose details are given in the Legal Notice. By using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service is, and is not

HoopSide publishes AI-generated analyses of basketball games (currently the NBA): recent form, head-to-head history, injury reports, predicted winners, scores, probabilities and scenarios. Analyses are produced automatically from third-party sports data and a language model.

• Analyses are for information and entertainment only. They are not betting, financial or any other professional advice.
• No prediction is guaranteed. Past accuracy, including the accuracy figures we display, does not guarantee future results.
• Our published accuracy only counts predictions made before tip-off, graded against the final score.
• If you choose to bet, you do so at your own risk, only where it is legal for you, and only if you are of legal age (at least 18, or older where local law requires).
• Sports data can be late or wrong. We do not guarantee that games, scores, injuries or statistics are complete or accurate.

3. Accounts

You can browse games without an account. Reading an analysis requires signing in with a Whop account; Whop, Inc. provides sign-in and its own terms apply to your Whop account. You must be at least 18 to create an account. You are responsible for activity on your account and must not share it with others.

4. Plans and payment

• Free: the partial analysis of every game.
• Starter ($10 per month): one full analysis per day (UTC), plus the partial analysis of every game.
• Pro ($19 per month): every analysis in full.
• Lifetime ($99, paid once): everything in Pro for as long as the Service operates, with no recurring payment.

Prices are in US dollars; applicable taxes are calculated and added at checkout. Payments are processed by Whop, Inc. Monthly plans renew automatically every 30 days until cancelled. You can cancel at any time from the billing page on Whop; your plan stays active until the end of the period already paid. We may change prices for future billing periods and will tell you before a change applies to you.

5. Right of withdrawal and refunds

If you are a consumer in the European Union, you normally have 14 days to withdraw from an online purchase. Because paid plans give you digital content immediately, you lose this right once your access starts, provided you expressly asked for immediate access and acknowledged losing the right at checkout.

If you were charged in error or cannot access what you paid for, contact us at [contact email] within 14 days of the charge and we will review your request. Nothing in these Terms limits the rights you have under the consumer law of the country you live in.

6. Acceptable use

You agree not to:

• copy, scrape, resell or republish analyses, or make them available to people without their own plan;
• use bots or automated tools to access the Service, or try to get around the paywall or usage limits;
• interfere with the Service's security or operation.

We may suspend or close accounts that break these rules.

7. Intellectual property

The Service, its design and its analyses belong to the publisher. Your plan gives you a personal, non-transferable right to read them. Team names and logos belong to their owners and are used only to identify games. HoopSide is not affiliated with, endorsed or sponsored by the NBA or any team.

8. Availability and liability

We aim to keep the Service available but do not guarantee it will be uninterrupted or error-free, and we may change or stop features. To the extent the law allows, we are not liable for indirect losses or for any loss arising from decisions you make based on an analysis, including betting losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing here excludes liability that cannot be excluded by law.

9. Changes to these Terms

We may update these Terms. For material changes we will give notice on the Service before they take effect. Continuing to use the Service after that means you accept the new Terms.

10. Governing law and disputes

These Terms are governed by French law, without depriving you of the protection of the mandatory rules of the country where you live. Please contact us first so we can try to resolve any issue.
